By accessing or using Aivene (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Aivene.
Aivene provides an AI gateway that allows developers and businesses to access multiple large language model providers through a single OpenAI-compatible API. Features include unified API access, spend controls, usage monitoring, and request routing across supported model providers.
You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that you are using the Service for lawful purposes only.
You are responsible for maintaining the confidentiality of your API keys and account credentials. You are fully responsible for all activity that occurs under your account. You must immediately notify us of any unauthorized use of your account or API keys. We will not be liable for any losses caused by unauthorized use of your credentials.
You agree not to use the Service to:
Certain features of the Service require payment. You agree to pay all fees and charges associated with your account on a timely basis. All fees are exclusive of applicable taxes. We reserve the right to modify pricing at any time with reasonable prior notice. Refunds, if any, are issued at our sole discretion.
You may set spend limits and budget controls within the Service. We will make reasonable efforts to enforce these limits, but cannot guarantee that spending will never exceed configured thresholds due to network latency, processing delays, or other technical factors. You remain responsible for all charges incurred on your account.
The Service routes requests to third-party AI model providers (e.g., OpenAI, Anthropic, Google, and others). These providers have their own terms of service and usage policies that apply to your requests. We are not responsible for the availability, accuracy, or output of third-party models. By using the Service, you also agree to comply with the terms of the underlying model providers.
The Service, including its software, design, logos, and documentation, is owned by us and protected by applicable intellectual property laws. You retain ownership of any content or data you submit through the Service. By submitting content, you grant us a limited license to process such content solely for the purpose of providing the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page or by other means. Your continued use of the Service after any changes constitute your acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction, as mutually agreed upon.
